Terms of Service
These Terms of Service (the “Terms”) form a binding agreement between you and Delicious LLC (“we,” “us,” or “our”) and govern your use of the Tasteful mobile application and related services (the “App”). By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. Eligibility and Accounts
You must be at least 18 years old (or the age of majority where you live) and able to form a binding contract to use the App. To create a restaurant account, you must be authorized to represent the restaurant you register. You are responsible for the accuracy of the information you provide and for keeping your login credentials secure. You are responsible for all activity that occurs under your account.
2. License to Use the App
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on a device that you own or control, solely for your personal or internal business use. You may not copy, modify, reverse engineer, distribute, or create derivative works of the App except as permitted by law.
3. User Content and Acceptable Use
The App allows restaurant account holders to upload content such as menu information and dish photos (“User Content”). You retain ownership of your User Content, but you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display that User Content for the purpose of operating and providing the App. You represent that you own or have all rights necessary to submit your User Content and that it does not infringe the rights of others.
Zero tolerance for objectionable content and abusive behavior. There is no tolerance for objectionable content or abusive users on the App. You agree not to upload, post, or transmit any content, or engage in any conduct, that:
- is unlawful, infringing, fraudulent, deceptive, or misleading;
- is obscene, pornographic, or sexually explicit;
- is hateful, harassing, threatening, defamatory, or that bullies or intimidates any person;
- depicts or promotes violence or illegal activity;
- violates the intellectual property, privacy, or other rights of any third party; or
- contains malware or attempts to interfere with the operation or security of the App.
Reporting and moderation. Users can report objectionable content directly within the App using the report control available on dish photos. We review reports of objectionable content or abusive users and will act within 24 hours by removing content that violates these Terms and ejecting (banning) the user or restaurant responsible for it. We may also remove content and suspend or terminate any account, at any time and without notice, for conduct that we believe violates these Terms or is otherwise harmful.
4. Intellectual Property
The App and all related software, design, text, graphics, and other materials (excluding User Content) are owned by Delicious LLC or its licensors and are protected by intellectual property laws. These Terms grant you no rights in the App except the limited license described above.
5. Third-Party Services
The App relies on services provided by third parties, including Apple, Google, and our service providers. Your use of those services may be subject to their respective terms. We are not responsible for third-party services and do not control them.
6. Disclaimer of Warranties
The App is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or secure, or that any information in the App (including restaurant or menu information) is accurate or complete.
7. Limitation of Liability
To the maximum extent permitted by law, Delicious LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or relating to your use of the App. Our total liability for any claim relating to the App will not exceed one hundred U.S. dollars (US $100).
8. Termination
You may stop using the App at any time and may delete your account from within the App. We may suspend or terminate your access to the App or your account at any time if you violate these Terms or if we discontinue the App. Sections that by their nature should survive termination (including Sections 4, 6, 7, and 10) will continue to apply.
9. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the “Effective date” above and post the updated Terms at this location. Your continued use of the App after changes take effect means you accept the updated Terms.
10. Apple App Store Additional Terms
The following applies if you obtained the App from the Apple App Store:
- These Terms are between you and Delicious LLC only, not with Apple. Apple is not responsible for the App or its content.
- Apple has no obligation to provide any maintenance or support for the App.
- To the maximum extent permitted by law, Apple has no warranty obligation with respect to the App. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); Apple has no other warranty obligation.
- Apple is not responsible for addressing any claims relating to the App, including product liability, legal or regulatory compliance, or consumer protection claims.
- Apple is not responsible for the investigation, defense, settlement, or discharge of any third-party claim that the App infringes intellectual property rights.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you.
11. Google Play Additional Terms
If you obtained the App from Google Play, you acknowledge that these Terms are between you and Delicious LLC only, and not with Google. Google is not responsible for the App or its content.
